Story: The Islamabad High Court on Wednesday (October 4) said the hearing of former prime minister Imran Khan’s bail plea in the cipher case would be held in an open court as the trial court adjourned the hearing until October 9.

The Islamabad High Court issued a reserved decision on the FIA's (Federal Investigation Agency) request for an in-camera hearing on Imran Khan's bail plea in the cypher case.

"The hearing of the cypher case to be held on October 9 at 2 pm in the open court. During the hearing, the information that the lawyers will mark as sensitive will be in-camera,"The High Court said in its verdict.

Earlier, the special court hearing the cipher case at Adiala jail in Rawalpindi adjourned until October 9.

While talking to the media outside jail, Khan’s lawyers called the in-camera trial of Imran and former foreign minister Shah Mahmood Qureshi in the cipher case “unconstitutional”.

A lawyer and member of legal team of ex-prime minister Imran khan, Khalid Yousuf Chaudhy, said they had filed an application to the trial court on Wednesday (October 4) to stop in-camera proceedings till the decision of Islamabad High Court.

“Today, we filed an application to stop the in-camera proceedings and stop the trial till the decision of the Islamabad High Court in which we challenged the in-camera proceedings of the cipher case and we have requested the Islamabad High Court to order an open trial in cipher case, should be in open place, open court. The general public should be allowed access to the court to see and listen the trial proceeding. Today, the trial court accepted our application and postponed the trial till 9th of the October,”he said.

The Federal Investigation Agency (FIA) submitted the charge sheet against Khan, the chairman of the Tehreek-e-Insaf (PTI) party and his ex-foreign minister Shah Mehmood Qureshi to a special court established under the Official Secrets Act.

Khan, 70, was arrested last month after a case was filed against him for allegedly violating the Official Secrets Act by disclosing a secret diplomatic cable or cipher sent by the country's embassy in Washington last year in March.
